Notice of Second Public Hearing to Discuss Outcomes of Allegany County’s CDBG Grant Funded Manufactured Home Replacement Program

These notices shall satisfy procedural requirements for activities to be undertaken by Allegany County.

The Allegany County Board of Legislator’s will convene a second Public Hearing on March 22, 2023, at 2:00 P.M. in the County Legislators’ Chambers, Room 221, County Office Building, 7 Court Street, Belmont, New York to discuss the outcomes of Allegany County’s CDBG Manufactured Home Replacement Program CDBG Contract #20MH126-20 in collaboration with Cattaraugus Community Action Agency.

A second Public Hearing is required following 75 percent of the contract budget disbursement and prior to the final funding draw request. The CDBG Contract #20MH126-20 grant award was $500,000 and was provided in collaboration with Cattaraugus Community Action Agency. The contract will expire on June 23, 2023.

EXPLANATION OF THE OUTCOMES ACHIEVED

The Manufactured Home Replacement Program provided three new homes for income individuals living in Allegany County. Older and unsafe mobile homes were replaced with new energy star efficient units (14 x 66ft). Site work included asbestos testing and abatement and demolition and disposal of old units. New units were placed on permanent engineered concrete slab foundations with concrete block skirting and installation included new steps/ramp and porch railings. Other site work included reconnecting utilities, a licensed electrician inspection, and code inspection and issuance of Certificates of Occupancy for new units.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on Allegany County’s CDBG funded Manufactured Home Replacement Program. Please submit your comments by email to Carissa M. Knapp, County Administrator at Carissa.knapp@alleganyco.gov or by mail Carissa M. Knapp, County Administrator 7 Court Street, Rm 213, Belmont, NY 14813. All comments received by close of business March 20, 2023 will be considered by Allegany County. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

Allegany County certifies to the Office of Community Renewal that Carissa Knapp, in her capacity as Allegany County Administrator, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Office of Community Renewal’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Allegany County to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

The Office of Community Renewal will accept objections to its release of funds and the certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Allegany County; (b) Allegany County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Office of Community Renewal; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Crystal Loffler at Crystal.Loffler@nyshcr.org. Potential objectors should contact OCRINFO@nyshcr.org via email to verify the actual last day of the objection period.
